Ontario Energy Board Notice to Customers of Union Gas Limited and Tipperary Gas Corp.

Union Gas Limited currently owns 75% of the Shares of Tipperary Gas Corp. and has applied to the Ontario Energy Board for approval to purchase all of the remaining voting shares. Tipperary Gas Corp. is the general partner of Huron Tipperary Limited Partnership 1, which carries out a non-utility natural gas storage business consisting primarily of two natural gas storage pools in the Municipality of Central Huron (“Tipperary Pools”).

Tipperary Gas Corp. has jointly applied to the Board for approval to transfer the authority to operate the Tipperary Pools from Tipperary Gas Corp. to Union Gas Limited.

Union Gas Limited has also asked the Ontario Energy Board to cancel the exemption from the Affiliate Relationships Code which it currently holds, but will no longer be required if the acquisition is completed.


The Ontario Energy Board (OEB) will hold a public hearing to consider the application filed jointly by Union Gas and Tipperary Gas Corp. We will question both companies on the case. We will also hear arguments from individuals and from groups that represent the customers of both Union Gas and Tipperary Gas Corp. At the end of this hearing, the OEB will decide whether to approve the application.

You have the right to information regarding this application and to be involved in the process. You can:

  • review the application filed jointly by Union Gas and Tipperary Gas Corp. on the OEB’s website now.
  • file a letter with your comments, which will be considered during the hearing.
  • become an active participant (called an intervenor). Apply by October 10, 2014 or the hearing will go ahead without you and you will not receive any further notice of the proceeding.
  • at the end of the process, review the OEB’s decision and its reasons on our website.

There are two types of OEB hearings – oral and written. Union Gas and Tipperary Gas Corp. have applied for a written hearing. The OEB is considering this request. If you think an oral hearing is needed, you can write to the OEB to explain why.

However, your personal telephone number, home address and email address will be removed. If you are a business, all your information will remain public. If you apply to become an intervenor, all information will be public.

This hearing will be held under sections 43(2)(a) and 18(1) of the Ontario Energy Board Act, 1998, S.O. 1998 c.15 (Schedule B).
